From 24 to 28 June 2024, the Sino-German Legal Cooperation Programme, together with the Treaty and Law Department of the Ministry of Commerce (TLD MofCom), held an annual training course on business law.
The five-day training course was attended by 33 civil servants from various departments MofCom, who will also be able to pass on their knowledge to colleagues as multipliers after completing the course. The Sino-German Legal Cooperation Programme provided the speakers for five half days, who provided information on current developments in German and European commercial law; the Treaty and Law Department of MofCom organized presentations on innovations in Chinese law. This year’s program included the Data Act, AI Act, green trade and EU competition law.
Dr. Paul Vogel from Noerr Munich presented the new legal requirements and the most important regulatory content in the Data Act and AI Act respectively; Prof. HONG Yanqing from the Beijing Institute of Technology reported data governance and AI safety regulatory framework and priorities in China.
In the second thematic block, Mr. Pierre Leturcq from the Institute for European Environmental Policy in Brussels explained the EU Strategy for Trade and Sustainable Development (TSD). In particular, he presented on recent developments in EU free trade agreements and focused on EU autonomous measures, as well as the EU Carbon Border Adjustment Mechanism (CBAM) and the Sustainable Business Due Diligence Directive (CSDDD). In comparison, HE Qi from the Research Institute for Global Value Chains at the University of International Business and Economics presented Green “Belt and Road” and Trade in Environmental Goods.
In the third session, Adrian Emch, Partner at Hogan Lovells, then explained the profound reform of EU competition law, particularly the Digital Markets Act (DMA) and the Foreign Subsidies Regulation (FSR). From a Chinese perspective, Ding Ru from the School of International Law of China University of Political Science and Law, explained New Developments in International Subsidies Rules and Reform of WTO Subsidies Rules.
