Objective
The objective of the action field is to increase legal certainty through the equitable, uniform and transparent application of legal norms by ministries and administrative authorities. The Sino-German Legal Cooperation Programme thus supports the training of Chinese civil servants and administrative staff in the methods of the application of norms according to the rule of law. Alongside this, the consolidation of specialist knowledge in selected areas of law is also facilitated.
Partners
In collaboration with the Federal Ministry of Justice and Consumer Protection, the project organizes training courses on administrative law topics with the Chinese Ministry of Justice. In the area of commercial law, the Programme cooperates with the Chinese Ministry of Commerce and the State Administration for Market Regulation. Consumer protection is strengthened through joint events with the Chinese Consumers Association.
Approach
The special advisory services are provided through workshops, symposia, training courses and study tours. At the events, the participants are presented with knowledge and experience from Germany and Europe on selected legal topics and introduced to the methods of the application of norms according to the rule of law. In this way, the participants learn how to integrate the specialist knowledge and methods they acquire into their own work and to apply them when making decisions and providing grounds for their decisions. The topics presented here range from administrative law to trade law, cartel law and trademark law, and all the way to consumer and data protection law. In addition, through support in the development of tools for the application of norms according to the rule of law – such as model solutions or legal commentaries – the transparency and comprehensibility of administrative decisions are strengthened.
